I am a digital illustrator who creates narrative-driven and character-driven artwork. I take inspiration for my work from World War One, dystopia, folklore, horror media, and my own personal experiences. My style is bold and gritty to convey the hurt that drives each piece I create.

TERMS OF SERVICE

This contract recognizes the artist being commissioned and the client. This contract binds the creative services to the client.

Payment

All payments shall be sent through the Artistree link provided. No other payment method such as direct cash, check, or money order shall be acceptable for creative services The artist, however, may be willing to compromise in methods of payment if contacted by email at [email protected]The agreed payment structure for the duration of this project is:
100% due up front
Violation of this payment structure will result in a Breach of Contract, thus forfeiting the completed or incomplete assets created by the artist. If services are not performed by the artist, artist name, then the client, is entitled to a refund of services not completed.

Pricing

The agreed upon pricing for the components of this project are as follows:

Graphic Drawing: $45 - $150
Digital Painting: $100 - $200
Additional Character: +20%
Complex Background: +20%

Anything outside the scope of the pricing options above will be agreed upon, in writing, between the artist and the client.

Rights To Assets

The assets created for the client by the artist are meant to be for personal, non-commercial purposes. Therefore, the following guidelines are in place:

The client may not claim the artwork as their own
The client may not utilize the artwork, nor any assets of the project, for NFT’s
The client may not utilize the artwork, nor any assets of the project for artificial intelligence training
The client must credit the artist when sharing or displaying the artworks in any venue, including, but not limited to, social media websites and platforms
The client may not publish the artworks without permission of the artist, artist name.
The client shall be given completed assets in .JPEG, or .PNG formats

Any alterations to these guidelines must be agreed upon, in writing, and signed by both parties. If any artworks are to be published, or if the client is to be compensated from a third party for the assets created by the artist, then additional compensation will be agreed upon.

The artist retains a portion of the intellectual property of all artworks. Therefore, the following guidelines are in place:

The artist retains the right to display any artwork created for promotional purposes
The artist may publish artwork to social media and other internet platforms for promotional purposes
The artist may not sell prints of any artwork without the consent of the client
The artist retains the rights to the .PSD original files

Any alterations to these guidelines must be agreed upon, in writing, and signed by both parties. If any artworks are to be published, or if the artist is to be compensated from a third party for the assets created for the client, then the artist will seek approval from the client. The client will have 7 days to respond to a request for approval from the artist. Upon midnight of the seventh day. or the client will forfeit their consent so long as documentation of communication is evident.

Alterations to Artworks

The client is allotted up to 2 alterations to any artwork created by the artist. Any alterations must be requested, in writing, within 24 hours. Any alterations requested outside of the 24 hour window may be subject to an additional charge. Any requested alteration that the artist deems significant and excessive may be subject to an additional charge.

Release of Assets

Completed assets for this project will be sent via email to the client. The client shall approve a low resolution, watermarked image of each completed asset prior to sending final payment. No completed artwork will be released to the client without prior collection of payment. Failure to provide payment may result in a Breach of Contract.

Breach of Contract

The client and the artist agree to all terms within this contract. Any action taken, willingly or unknowingly, to violate the terms of this contract may result in a Breach of Contract. This contract shall become null and void if there is an unresolved dispute over the following items:

Failure to correctly provide payment for creative services
Failure to credit artist when displaying artwork
Fraudulently claiming artwork is the product of the client
Violating the Rights of Assets
Failure to communicate requests for alterations
Excessive alterations to artwork
Intolerable treatment towards the artist
Requesting artwork that the artist is not comfortable creating (i.e. nude, pornographic, or adult content)
Client’s continued dissatisfaction with the assets completed
Failure to provide client with completed assets

If this contract is breached, payment for any services leading up to the breach of contract may be rendered. If the terms of this contract become dissatisfactory to one or both parties, then a new contract shall be created containing the new, agreed upon terms.

Approval

Upon commissioning the artist, the client will agree to all terms outlined in this contract.
